SDPI Welcomes Bombay High Court Judgement On Tabligh Jama at ForeignersMohammed Shafi, national general secretary of Social Democratic Party of India (SDPI) has welcomed the Bombay High Court judgment on Tabligh Jama at foreigners who were booked under various provisions of IPC, Epidemic Diseases Act, Maharashtra Police Act, Disaster Management Act and Foreigners Act. Bombay High Court has quashed the FIRs against 29 foreign nationals and stated that the accused were made ‘scapegoats’. Six Indian nationals also were booked allegedly for providing shelter to these foreigners. The judgement was on three separate petitions filed by foreign nationals from countries like Ivory Coast, Ghana. Tanzania, Djibouti, Benin and Indonesia. The petitioners arrived in India on valid visiting visa issued by the Government of India to attend Tabligh Jama at congregation at the Nizamudeen Markaz in Delhi, in March. They had informed the District Superintendent of Police about their arrival in Ahmednagar district. They had also informed the local officers even though the visa conditions didn’t stipulate it. There was no prohibition to visit religious places, as well. They were stranded in Delhi following the nation-wide lockdown imposed on 23rd March due to Covid19. Transport facilities were stopped and lodges and hotels were shut and so they were accommodated in the Masjid. They were not involved in any criminal activities or breach of order of the District Collector.The Islamophobic bigot central government, remote-controlled by the RSS was exploiting the helplessness of these visitors to vilify Muslims alleging that these foreigners caused spread of Covid19 in the country. The petitioners were subjected to screening and tested for Covid19 at the airport on their arrival. They were allowed to leave the airport only after they were tested negative. The pro-Modi, pro-RSS media had since taken over the duty of spreading the false news and maligning a community to serve their vicious agenda.Division Bench of the Aurangabad bench of Bombay High Court consisting of Justice TV Nalawade and Justice MG Sewilkar in while disposing of the petitions filed by 29 foreign nationals had quashed all the FIRs against them, strongly criticised the media propaganda and stated that the hapless petitioners were made scapegoats. The court has commented that “it is now high time for the concerned to repent about this action taken against the foreigners and to take some positive steps to repair the damage done such action,” referring to the unjust treatment meted out to the petitioners. The statement by the court “a political government tries to find scapegoats when there is pandemic or calamity and the circumstances show that there is probability that these foreigners were chosen to make them scapegoats the aforesaid circumstances and the latest figures of infection in India show that such action against present petition should not have been taken,” is a strong blow to the government and the biased and bigot media playing the dirty communal politics of hatred.
