MALICE TO NONE AND JUSTICE TO ALL IS PRIME MOTTO- SDPINew Delhi, August 18th, 2020Social democratic party of India (SDPI) has thoroughly been studying and keenly following the pronouncements of the Supreme Court. SDPI has also occasionally been intervening in some legal matters of public importance at judicial fora. It was a great day for Indian judiciary in the country when four the most senior judges of the Supreme Court openly and unconventionally came out of Court to pitch for strong democracy in India. The whole of the country applauded the event and held the judiciary and Supreme Court particularly in high esteem. Though, there have been some occasions when people were found appalled but Supreme Court often by overruling past errors continue to hold the dignity and enjoy the respect of the country. It took an astonishing turn in the history of Supreme Court when a three jugdes bench of Justice Arun Mishra, Justice R Gavai and Justice Krishan Murari took up suo moto cognizance of two tweets of Advocate Prashant Bhushan and initiated contempt proceedings issuing notice to him and also dug out another case of contempt of the year 2009 pending against Prashant Bhushan which has been heard earlier by other benches and was kept matter at evidence in view of the involved procedural intricacies that indicated to open a pandora’s box. It was felt that this bench of Supreme Court has become over-sensitive and over-exercised in view of the haste in fixing the date against the established procedure of Supreme Court as well as in change rules during pandemic period and also against the established principle of the authority of the master of the roster of the Supreme Court. The three Judges bench of the Supreme Court has pronounced that Prashant Bhushan is guilty of contempt and so is liable for sentence under the provisions of the Contempt of Courts Act. 20th of August is fixed to decide the quantum of sentence. On account of yeomen service of Prashant Bhushan as taking up the brief in a number of cases of public interests and sincerely keeping himself involved in all the matters of public importance for the sake of noble ideals of justice, democracy and the country, a feeling is instantly generated that a large number of retired judges, noted jurists, intellectuals, political and social activists have felt anguished and a large public opinion has meanwhile emerged. It appears now that as matter of fact Prashant Bhushan has got the support of all those who have conscience, empathy and courage. The country salutes to Mr. Prashant Bhushan for his grit and high ideals. He has unfailingly been fighting to uphold values and norms incurring a number of loses and stakes in his professional life. A large number of citizens seem to be, with him in these testing moments for protecting entire constitutional system. Prashant Bhushan in the most critical moments in Indian democracy has been carrying on struggle for high values. His unwavering stand staking all-for-no-gain put him in class of conscience warriors. He is new Jaiprakash Narain India needs just now.SDPI keeping in view solemn ideals, the high standard of our judicial and democratic premise, sincerely appeals that any sort of vindictiveness be set aside in the best of the interests of the judicial system and democracy of our country. The contempt proceedings against Advocate Prashant Bhushan be dropped from sentencing for making tweets on social media in view of the sacred principle that no offence is committed by mere words if not followed by any criminal action. We are at crossroads to take lead to a right path so that it may be proved that India thrives on the real values of democracy adjusting all kind of the dissents, disagreements and diverse opinions of all the people, malice to none and justice to all.
