The Supreme Court verdict upholding the constitutionality of the UP Madrasa Education Act 2004 is a blow to the attempts from various quarters to sabotage the Madrasa education in the country.The Allahabad High Court in March 2024 had struck down the Act saying that it violated the principles of secularism.The Madarsa Act provides the legal framework for Madarsa education where, apart from the curriculum of the National Council of Educational Research and Training (NCERT), religious education is imparted as well.The observations of CJI Chandrachud that “to throw out the (Madarsa) Act is to throw the baby out with the bathwater” and his comments that the state government has the power to make rules under the Act to ensure that the education imparted is more secular in nature clearly connote that applying remedial measures, not undermining a system is the solution if there are shortfalls in the system.Mohammad ShafiNational Vice President
