The Lucknow CBI Special Court verdict acquitting all the accused in the Babri Masjid demolition case, though not unexpected in the present Indian political scenario, is highly frustrating and it totters the hope of the common people in the Indian judiciary. The Court observation that the demolition was not a planned activity and the accused were not involved in the crime is nothing less than mockery of justice, responded MK Faizy, National President of Social Democratic Party of India about the verdict. The nation has once again been betrayed. Justice in India has become a reverie, he said.It had been violating all norms and assurance given to the Supreme Court that the historic Babri Masjid in Ayodhya was demolished by the right wing Hindutwa fascist karsevaks led by senior BJP and Hindutwa outfits leaders LK Advani, Uma Bharathi, Vinay Kathyar, et al, with the whole world watching live the demolition. The then Prime Minister of India Narsimha Rao of Indian National Congress took an ostrich stance while the masjid was demolished, and the entire governing systems in UP and at the Centre tacitly supported the demolition without taking any effort to deter and stop the karsevaks from demolishing the masjid structure. Liberhan Commission appointed to enquire the demolition in its report submitted 17 years after the demolition had stated that the demolition of the Babri Masjid was planned, systematic, and was the intended outcome of a climate of communal intolerance deliberately created by the Sangh Parivar and its sister affiliates, including the Bharatiya Janata Party. The report places a total of 68 persons, the bulk of them drawn from the extended Parivar clan comprising the Rashtriya Swayam Sevak Sangh, the Vishwa Hindu Parishad, the Bajrang Dal and the BJP responsible for the demolition. The BJP contingent includes not just Hindutva ideologues Lal Krishna Advani and Murli Manhohar Joshi, but, surprisingly, also the party’s celebrated moderate face, Atal Bihari Vajpayee too was mentioned amongst the culprits. Justice Liberhan goes on to say, “It cannot be assumed even for a moment that L.K. Advani, A.B. Vajpayee or M.M. Joshi did not know the designs of the Sangh Parivar. Even though these leaders were deemed and used by the Parivar … to reassure the cautious masses, they were [in fact] party to the decisions which had been taken.”The Lucknow CBI Special Court judge Surendra Kumar Yadav seems to have not known the Liberhan Commission findings which categorically implicate all of those who have been exonerated today by him, as the masterminds of the demolition. Astonishingly the judge has conferred on LK Advani and Murali Manohar Joshi the credit of preventing the mob from demolishing the masjid. The Rath Yatra conducted by LK Advani across the country calling for construction of Ram Temple where Babri Masjid existed hadn’t been a clandestine activity. The whole world had witnessed each and every movement of the Sangh Parivar to demolish and in demolishing Babri Masjid. All the leaders who have been given good conduct certificate today by Surendra Kumar Yadav had been physically present at the spot enjoying and encouraging the karsevaks to destruct the masjid. The CBI Special Court has not taken into account any findings of the Liberhan Commission or the investigation report of CBI while honouring the culprits in a criminal offence that had stained the image of the country in front of the world. It is in this more than a quarter century old criminal case, the CBI Special Court has pronounced the judgment today. Decades long civil suit on the title dispute of the Babri Masjid land was disposed by the Supreme Court of India in November 2019, awarding the land of the Masjid for temple construction, blatantly against its own findings that the demolition was illegal and demolition was a criminal offence. The CJI who proclaimed this bizarre judgement was ceremoniously honoured by the Sanghi central government by awarding him the MP post in Rajyasabha. Today’s verdict unambiguously reinforces the fact that the enticement bait of the central government is functioning well. The CBI Special Court judge Surendra Kumar Yadav has easily fallen to the bait dreaming of higher honours from the government as quid pro quo for the judgement. The Sangh Parivar through meticulous planning has gradually erased democracy and developed a strong network of pro-sanghi bureaucracy and judiciary to support all their illegal and anti-democratic acts and activities. Instead of silently surrendering to the injustice being dispensed by the system, people should wake up, fight and defeat fascism if at all the nation of diversity should exist, and the future generations live with peace and harmony, reminded Faizy.
