The proposal to amend nuclear liability law to boost foreign and private investments in the much-guarded nuclear energy sector comes ahead of Prime Minister Narendra Modi’s US visit.
The Civil Liability for Nuclear Damage Act, 2010 establishes a no-fault liability regime in India, ensuring compensation for nuclear incident victims. It mandates operators to secure insurance and caps liability at ₹15 billion, with the government covering additional costs up to 300 million SDR. The Act also mandates that operators must secure insurance or provide financial security to cover their liabilities. It aims to streamline the compensation process by appointing a Claims Commissioner and establishing a Nuclear Damage Claims Commission, thereby ensuring that victims receive timely redress.
