Mohammad Saqib’s Acquittal Exposes Misuse of Anti-Conversion Law: Time to Repeal
In a powerful vindication of justice, Mohammad Saqib has been cleared of all charges in a closely watched case under the Uttar Pradesh Prohibition of Unlawful Religious Conversion Act, 2020. The ruling by the Additional District and Sessions Judge / Special Judge (POCSO Act) in Bijnor exposes the misuse of this controversial law and fuels calls for its withdrawal.
The case filed at Dhampur Police Station, stacked charges under Sections 354, 363, and 366 of the Indian Penal Code, Sections 7/8 of the POCSO Act, Section 3(2)(5) of the SC/ST Act, and Sections 3/5(1) of the anti-conversion law. After thorough evidence scrutiny and fair hearings, the court’s decision highlights the law’s overreach and questions its legitimacy. This case was among the first and most widely discussed cases registered under the newly implemented anti-conversion law that came into effect in November 2020.
Senior Advocate Komal Singh and Advocate Mashroof Kamal’s incisive defense, grounded in evidence and legal precision, dismantled the prosecution’s case, securing this landmark acquittal.
