
Elyas Muhammad Thumbe, the National General Secretary of Social Democratic Party of India expressed concern about the CJI Chandrachud’s connotation that the Babri Masjid verdict was the result of divine intervention. Judicial decisions should be based on facts and evidences, not on one’s religious faith and beliefs, said Elyas. The CJI, during a speech in an event in Pune, said that the Ayodhya-Babri Masjid dispute was a case which was difficult to adjudicate and he had to pray to God to find a solution. His statement unambiguously pronounces that the judgement was influenced by his beliefs rather than principle of justice. If the judge is influenced by his beliefs rather than facts and evidences while pronouncing judgements, then what the aggrieved in the cases would get is absolute injustice. It is saddening that the judicial officers are trying to swim with the tide. The judges should show more prudence, maturity and wisdom while discharging their duties and responsibilities, said Thumbe.
