High Court Stay in Sambhal Shooting Undermines Justice

Dahlan Baqavi, National Vice President of the Social Democratic Party of India, has expressed deep shock and outrage over the Allahabad High Court’s decision to stay the order directing the registration of an FIR against police officers in connection with the gunshot injuries inflicted on Mohammad Alam during the Sambhal violence. He stated that this ruling delivers a serious blow to the pursuit of justice by the victims and their families.

Mohammad Alam, a young biscuit seller with no involvement in any protest, sustained multiple gunshot wounds, including two in his back. Medical records confirm that these injuries occurred during police action on 24 November 2024. After examining the evidence, the lower court had found sufficient grounds to register a case. However, the High Court’s stay has halted the process of accountability on procedural grounds, effectively shielding those responsible.

Baqavi noted that the decision overlooks compelling medical evidence and reinforces a disturbing pattern in Uttar Pradesh, where allegations of police excesses against Muslims frequently go unpunished. The Sambhal violence, which drew nationwide attention, saw swift action against alleged rioters while those accused of firing on civilians appear to remain shielded from accountability.

Such developments erode public trust in the judiciary and law enforcement and create a perception of impunity for uniformed personnel when dealing with minority communities. The Social Democratic Party of India demands the immediate lifting of the stay, prompt registration of the FIR, and a credible independent investigation. The SDPI stands firmly with the victims’ families and affirms that its struggle for justice will continue until accountability is ensured.
